Informative in fulfillment with the obligations under the obligations provided for by the Art. 10 of the Directive n. 95/46/CE, by the Directive 2002/58/CE, as updated by the Directive 2009/136/CE, by the article 13 of the Legislative decree 30 June 2003, number 196, and by the general provision (doc. web n. 3118884) of the Guarantor for the protection of the personal data, published on the Gazzetta Ufficiale n. 126 on 3 June 2014, registry of the provisions n. 229 on 8 May 2014 in the field of Cookie, having "Individuazione delle modalità semplificate per l'informativa e l'acquisizione del consenso per l'uso dei cookie (Identification of the simplified procedures for the information and the acquisition of the consent for the use of the cookies)"
Information about cookies
The Cookies are small text strings that the sites visited by the user send to his terminal (usually to the browser), where they are stored before being transmitted back to the same sites at the next visit to the same user. During the browsing on a site, the user can receive on this terminal even cookies that are sent from different websites or web servers (known as "third parts"), on which may be located some elements (such as, for example, images, maps, sounds, specific links to pages of other domains) available on the site that the same is visiting. Cookies, usually present in the users' browsers in a very large number and sometimes with characteristics of wide temporal persistence, are used for different purposes: execution of informatic authentications, sessions tracking, memorisation of informations of specific configurations about the users accessing the server, etc. In order to achieve a proper regulation of these devices, it's necessary to distinguish them considered that there aren't some technical characteristics that differentiate them from each other precisely on the basis of the aims pursued by those who use them. In this direction has moved, moreover, the legislator himself, which, in implementation of the provisions contained in the directive 2009/136/CE, has attributed the obligation to obtain the prior and informed consent of the user to the installation of the cookies used for different purposes from those purely technical. (cf. art. 1, comma 5, lett. a), of the Lgs. dec. 28 May 2012, n. 69, which has changed the art. 122 of the Code). In this regard, and for the purposes of the present provision, are therefore identified two macro-categories: "technical" cookies and "profiling" cookies.
a. Technical cookies.
Technical cookies are those used for the sole purpose of "carrying out the transmission of a communication over a network of electronic communication, or in the measure strictly necessary for the provider of an information society service explicitly requested by the subscriber or the user to provide such service" (cf. art. 122, comma 1, of the Code). They are not used for other purposes and they are normally installed directly by the owner or manager of the website. They can be divided in navigation or session cookie, which guarantee the normal navigation and use of the website (allowing, for example, to make a purchase or to authenticate to access restricted areas); analytics cookies, assimilated to the technical cookies when used directly by the website owner to collect informations, in aggregate form, about the number of the users and about how they visit the website itself; functionality cookies, that allow to the user the browsing in function of a series of selected criteria (for example, the language, the selected products for the purchase) in order to improve the service rendered to the same. For the installation of these cookies is not required the prior consent of the users, while it remains stable the obbligation to provide the information in accordance with the art. 13 of the Code, that the website manager, if he uses only those devices, may provide with the methods he considers most appropriate.
b. Profiling cookies.
The profiling cookies are designed to create profiles related to the user and are used in order to send advertising messages in accordance with the preferences expressed by the same in the context of surfing the net. Due to the particular invasivity that such devices may have within the private sphere of the users, the European and Italian legislation requires the user to be properly informed on the use of the same and express so their valid consent. The art. 122 of the Code refers to them where it provides that "the storage of the informations in the terminal equipment of a contractor or of a user or the access to informations already stored are only allowed on condition that the contractor of the user has expressed his consent after having been informed by the simplified procedures referred to the article 13, comma 3" (art. 122, comma 1, of the Code).
